Welcome to sarmadmughal.com (“the Site”). These Terms and Conditions (“Terms”) govern your access to and use of my website and my design subscription services (“Services”). By subscribing, accessing, or using my Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. About Me
sarmadmughal.com is operated by Sarmad Mughal, an independent designer providing on-demand design subscription services to clients worldwide.
Contact: hello@sarmadmughal.com
2. The Service
I provide a subscription-based design service. Clients submit design requests, and I deliver work within agreed turnaround times. The specific scope, deliverables, and revision rules of your plan are described on my pricing page at the time of subscription.
Design requests are typically handled one at a time in a queue. Turnaround times are business-day estimates and may vary based on complexity.
3. Subscription, Billing & Cancellation
Billing. Subscriptions are billed monthly in advance through my payment processor, Paddle.com Market Limited, which acts as the Merchant of Record for all transactions. Paddle handles billing, tax collection, and invoicing. In rare cases where Paddle is unavailable, I may invoice you via Wise as a backup.
Cancellation. You may cancel your subscription at any time. Cancellation stops future billing — you will continue to have access until the end of your current paid billing period. I do not pro-rate or refund partial months.
Pausing. Subject to plan availability, you may pause your subscription. Pausing details are managed via your account or by emailing me.
Failed Payments. If a payment fails, I may suspend the Service until the balance is settled. Repeated failed payments may result in termination.
4. Trial
I offer a 5 working day trial for $500. The trial gives you access to the Service for one work week so you can evaluate fit before committing to a full subscription. The trial fee is non-refundable once design work has begun.
5. Refunds
Please see my Refund Policy for full details. In short: once design work has started on a request or billing cycle, that period is non-refundable. You can cancel at any time to prevent future charges.
6. Client Responsibilities
To deliver good work, I need your cooperation. You agree to:
- Provide accurate briefs, brand assets, and any reference materials needed.
- Respond to questions and feedback in a reasonable time so I can keep your queue moving.
- Only submit requests for work you have the legal right to commission (no infringing logos, copyrighted material you don’t own, etc.).
- Not use the Service for unlawful, harmful, or deceptive purposes.
I reserve the right to decline or pause requests that violate these Terms or my policies.
7. Intellectual Property
Your content. Anything you send me (briefs, logos, photos, copy) remains yours. By sending it, you grant me a license to use it for the purpose of completing your requests.
My deliverables. Once a billing period is paid in full, you own the final delivered design files for that period and may use them commercially. Working files, drafts, and unused concepts remain mine unless otherwise agreed in writing.
Portfolio rights. Unless you ask me in writing to keep a project private, I may showcase delivered work in my portfolio, case studies, and marketing materials.
Third-party assets. Some deliverables may include licensed fonts, stock images, or icons. Those are licensed to you under the terms of the original provider — I don’t transfer ownership of third-party assets.
8. Acceptable Use
You may not:
- Resell or sublicense the subscription itself to third parties.
- Use the Service to produce content that is illegal, hateful, defamatory, or infringes anyone’s rights.
- Reverse engineer, scrape, or attempt to disrupt the Service.
Violations may result in immediate termination without refund.
9. Confidentiality
I treat your briefs, business information, and unreleased materials as confidential and don’t share them with anyone outside my workflow without your permission.
10. Disclaimers
The Service is provided “as is” and “as available.” While I work hard to deliver high-quality design, I make no guarantees about specific business outcomes (sales, conversions, brand performance, etc.). Design is collaborative — quality depends partly on the briefs and feedback you provide.
To the fullest extent permitted by law, I disclaim all implied warranties, including merchantability and fitness for a particular purpose.
11. Limitation of Liability
To the maximum extent permitted by law, my total liability for any claim related to the Service is limited to the amount you paid me in the three (3) months preceding the claim. I am not liable for indirect, incidental, consequential, or lost-profit damages.
12. Termination
You can cancel any time. I may suspend or terminate the Service if you breach these Terms, fail to pay, or misuse the Service. On termination, your access ends and any unpaid balances become immediately due.
13. Governing Law & Disputes
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict-of-law principles. Any dispute will first be attempted to be resolved informally by contacting me at hello@sarmadmughal.com. If that fails, disputes will be settled in the courts of Sialkot, Pakistan, unless local consumer protection laws in your country require otherwise.
If you are a consumer in the EU, UK, or US, nothing in these Terms removes statutory rights you have under your local law.
14. Changes to These Terms
I may update these Terms from time to time. The “Last updated” date at the top reflects the most recent version. Material changes will be communicated via email or a notice on the website. Continued use after changes means you accept the new Terms.
